In a major legal move with national implications, the U.S. Department of Justice filed a federal lawsuit this week against Kentucky Governor Andy Beshear, accusing him of violating federal law by offering in-state college tuition to undocumented immigrants.
The lawsuit alleges that a longstanding Kentucky regulation—dating back to 2010—allows certain undocumented students who graduate from Kentucky high schools to receive in-state tuition at public universities, while U.S. citizens from outside the state must pay the higher out-of-state rate. The DOJ claims this violates federal immigration law, which prohibits state or local governments from providing public benefits to illegal immigrants without specific legislation.
Attorney General Pam Bondi released a blistering statement:
“No state can be allowed to treat Americans like second-class citizens in their own country by offering financial benefits to illegal aliens.”
Governor Beshear’s office responded by claiming that the governor does not have the authority to change the policy, which was created by the Council on Postsecondary Education over a decade ago.
